Uh... when did the Judicial and Legislative branch have any bearing on this? The judicial branch has absolutely no bearing at all on it... and the legislative was never asked to declare war. The executive branch did this alone, entirely. Uh... you confused me abit with what you said there, but I think I can guess at what you are talking about. The vote that Bush called in Congress about using force in Iraq mean NOTHING. It was just that, nothing. It only said that they would support it, Bush did not require it(well according to his interpretation of the law) and it was nothing more than a good will effort with Congress. He went to war without a formal decleration of war, as so many presidents have in the past, violating the spirit of the constitution.
